Terms & Conditions of Hire
By making a booking with SWAT PARTY BUS, the person making the booking (“the Hirer”) agrees to the following Terms & Conditions on behalf of themselves and all passengers travelling as part of their booking.
1. Booking & Payment
A $300 deposit is required to secure and confirm your booking unless otherwise agreed with SWAT PARTY BUS management.
The remaining balance must be paid on or before the day of hire, unless alternative arrangements have been agreed with management.
Bookings made within 14 days of the hire date require full payment at the time of booking.
Payment may be made by bank transfer or other approved payment methods. Credit card payments may attract a processing fee where applicable.
Photo identification may be requested to verify the cardholder when payment is made by credit card.
Your booking is not confirmed until the required payment has been received and SWAT PARTY BUS has confirmed your booking.
2. Cancellations & Refunds
Please choose your booking date carefully.
If you cancel within 3 days of initially paying your deposit, your deposit will be refunded in full.
If you cancel more than 3 days after paying your deposit, the deposit is non-refundable.
If you cancel within 21 days of your hire date, the full booking amount is payable and no refund will be provided.
Bookings made within 14 days of the hire date require full payment at the time of booking. If you subsequently cancel, the full amount paid will be forfeited.
Where a booking has been paid in full and falls within the applicable non-refundable cancellation period, no refund will be provided.
Any variation, credit or transfer offered by SWAT PARTY BUS is at management's discretion unless otherwise agreed in writing.
3. Hirer's Responsibility
The person making the booking is responsible for the behaviour of all passengers in their group.
The Hirer is responsible for ensuring that everyone travelling on the bus understands and follows these Terms & Conditions and all reasonable instructions given by the driver or SWAT PARTY BUS staff.
The Hirer may be held responsible for damage, excessive cleaning, missing property or other costs caused by themselves or any member of their group.
4. Alcohol, Drinks & Food
CANS ONLY are permitted onboard.
For passenger safety: 2 drinks per passenger.
No glass bottles or glassware. No open cups or containers.No drinks that can easily spill throughout the vehicle. Food is not permitted unless prior approval has been given by SWAT PARTY BUS.
Passengers must comply with all applicable laws relating to alcohol consumption.
SWAT PARTY BUS reserves the right to refuse boarding to, or remove from the vehicle, any passenger whose level of intoxication or behaviour creates a safety risk.
5. Smoking, Vaping & Illegal Drugs
Smoking is strictly prohibited onboard all SWAT PARTY BUS vehicles.
The possession or consumption of illegal drugs is strictly prohibited.
Any illegal activity may result in the immediate termination of the hire without refund and, where appropriate, may be reported to the relevant authorities.
Any rules regarding vaping must be followed as directed by the driver and in accordance with applicable laws and regulations.
6. Passenger Behaviour & Safety
We want everyone to have an amazing time, but passenger safety and the protection of our vehicles and staff come first.
The following behaviour is not permitted:
Standing or dancing on seats, Hanging out of windows or doors.Opening emergency exits or emergency hatches except in a genuine emergency. Abusive, threatening, aggressive or violent behaviour.
Harassment or intimidation of the driver, staff or other passengers.Deliberate misuse of equipment or fittings. Wilful or malicious damage to the vehicle.
Behaviour that distracts the driver or compromises the safe operation of the vehicle.
Failure to follow reasonable instructions from the driver.
SWAT PARTY BUS and the driver reserve the right to immediately terminate the hire where passenger behaviour is unsafe, abusive, illegal or places the vehicle, driver, passengers or public at risk.
Where a hire is terminated because of passenger behaviour, no refund will be provided.
7. Damage to the Bus
The Hirer is responsible for damage caused to the vehicle, its equipment, fixtures or fittings by any member of their group.
This includes, but is not limited to, damage to:
Seats and upholstery, Cushions, Curtains & blinds, Carpet and flooring, Windows,Doors, Lighting,Audio or entertainment equipment, Interior or exterior fittings, Emergency exits or hatches
Any required repairs will be assessed and, where appropriate, quoted by a qualified repairer.
The Hirer may be charged the reasonable cost of repairing or replacing damaged property together with any applicable administration costs.
Where serious damage prevents the vehicle from operating, SWAT PARTY BUS may also seek recovery of reasonable losses directly resulting from the damage, where legally recoverable.
8. Cleaning Fee
Please respect our buses so the next group can enjoy them too.
A $250 cleaning fee may be charged where excessive cleaning is required as a result of passenger behaviour.
This may include, but is not limited to:
Vomiting or sickness inside the vehicle,Excessive spills,Food mess,Excessive rubbish, Soiling of seats, carpets or interior surfaces, Cleaning requiring carpet or upholstery treatment
Additional charges may apply where specialist cleaning or repairs are required beyond normal cleaning.
9. Security / Card Details
Where required, SWAT PARTY BUS may request valid payment or card details as security against authorised charges relating to damage, excessive cleaning or other amounts payable under these Terms & Conditions.
Any payment information will be handled in accordance with applicable payment and privacy requirements.
10. Personal Belongings
Passengers are responsible for their own personal belongings.
SWAT PARTY BUS accepts no responsibility for items that are lost, damaged or left behind in the vehicle, except to the extent that liability cannot legally be excluded.
If you believe you have left something onboard, please contact us as soon as possible and we will do our best to locate it.
11. Entertainment Equipment
Our sound, lighting, karaoke and other entertainment equipment is provided as part of the SWAT PARTY BUS experience.
While we make every reasonable effort to ensure equipment is operational, occasional technical faults can occur.
A malfunction of individual entertainment equipment that does not prevent the hire from proceeding safely does not automatically entitle the Hirer to a refund or compensation.
12. Vehicle Breakdown, Accident or Events Outside Our Control
SWAT PARTY BUS maintains its vehicles and takes reasonable steps to provide your booked service.
However, unforeseen circumstances can occur, including:
Vehicle breakdown, Accident, Road closures,Severe traffic delays,Emergency situations,Unsafe road conditions, Events outside our reasonable control.
If the booked vehicle becomes unsafe or unable to complete the service, SWAT PARTY BUS will make reasonable efforts to assist passengers and, where reasonably possible, arrange an alternative solution.
SWAT PARTY BUS cannot guarantee exact travel or arrival times where delays are caused by circumstances outside our reasonable control.
Nothing in these Terms & Conditions excludes any rights or remedies that cannot lawfully be excluded under Australian Consumer Law.
13. Driver Authority
The driver is responsible for the safe operation of the vehicle.
All passengers must follow reasonable instructions given by the driver relating to safety, passenger behaviour and the operation of the vehicle.
The driver's decision regarding immediate passenger and vehicle safety is final.
14. Refusal or Termination of Hire
SWAT PARTY BUS reserves the right to refuse boarding or terminate a hire where a passenger or group:
Is excessively intoxicated, Is aggressive, abusive or threatening. Creates a safety risk. Deliberately damages the vehicle. Uses or possesses illegal drugs.
Refuses to follow reasonable safety instructions. Behaves in a way that could endanger the driver, passengers, vehicle or public.
Termination under these circumstances may occur without refund.
The Hirer remains responsible for any damage, cleaning or other charges arising from their group's behaviour.
15. Acceptance of Terms
By making a booking and paying the required deposit or booking amount, the Hirer confirms that they:
Have read these Terms & Conditions.
Understand and accept them.
Accept responsibility for informing all passengers of the relevant rules.
Accept responsibility for their group's conduct during the hire.
These Terms & Conditions apply to all SWAT PARTY BUS bookings unless an alternative arrangement has been agreed to in writing by SWAT PARTY BUS management.
Definitions
SWAT PARTY BUS / Company: SWAT PARTY BUS and the operator providing the booked service.
Hirer: The person who makes the booking and is responsible for the booking.
Passengers / Group: All persons travelling under the Hirer's booking.
Hire Date: The date on which the booked service takes place.
Hire Time: The agreed period for which the vehicle has been booked.
Vehicle: The SWAT PARTY BUS vehicle allocated to the booking.
Driver: The authorised driver operating the vehicle.
Booking: The agreed SWAT PARTY BUS service confirmed between the Hirer and SWAT PARTY BUS.
